The Georgia Department of Revenue (GADOR) can use liens, levies, wage garnishments, and other collection activities to get you to pay your state tax debt. If you don’t resolve your Georgia state tax problems, expect GADOR to continue to pursue collection using some or all of these methods.

If you want to stop GADOR collection actions, consider resolving your tax problems using any of the following tax resolution strategies.

Georgia Monthly Installment Agreements

You can request a payment plan that allows you to pay off your tax debt over time. If you owe several types of taxes, you can have them all included in a single payment plan.

Your repayment period can last up to 60 months. However, your monthly payment can’t be less than $25. You can also make a down payment to reduce your total balance and allow you to pay less each month.

If you miss a payment, you could once again face bank account levies or wage garnishments. Negotiate a payment agreement that you can stick to and that has favorable terms.

Georgia Offer in Compromise

Like the IRS, GADOR has an Offer in Compromise program that allows some taxpayers to settle their debts for less than they owe. Eligibility will depend on your income, assets, and overall financial situation.

The Offer in Compromise application is complicated and not all taxpayers will qualify for this program. Get help from a Georgia tax attorney to make sure your application to completed correctly.

Georgia Penalty Relief

Georgia also offers relief from tax penalties in some cases. You must provide a compelling reason for your failure to comply with Georgia’s tax laws when you submit your penalty abatement request.

GADOR won’t consider your penalty relief request if you have outstanding tax debt or unfiled tax returns, so resolve these issues before you ask for penalty abatement.

Georgia Innocent Spouse Relief

GADOR provides for innocent spouse relief, similar to the IRS innocent spouse relief program. However, you can receive this relief if you have already been granted innocent spouse relief from a federal tax balance by the IRS.
